The High Court has upheld the conviction and sentence of former Kiambu Governor Ferdinand Waititu, his wife and their associates in a corruption case involving a KSh588 million road construction contract.
In a judgment delivered on October 14, 2026, Justice Rose Ougo upheld their convictions for corruption-related offences and overturned their acquittal on money laundering charges, according to the Ethics and Anti-Corruption Commission (EACC).
The other accused are Waititu’s wife, Susan Wangari Ndungu, former Kiambu County Chief Officer for Roads Luka Mwangi Wahinya, and Charles Chege Mbuthia, a director of Testimony Enterprises Limited.
The case followed investigations launched in 2019 into the alleged irregular award of a contract to upgrade gravel roads in five Kiambu sub-counties during the 2017/2018 financial year.
Waititu and his co-accused were convicted on February 12, 2025, of offences including conflict of interest, abuse of office and fraudulent procurement practices.
Separately, a court ordered the forfeiture of assets worth approximately KSh131.2 million linked to Waititu and associates in December 2025.
The EACC is also seeking to recover KSh170 million from Waititu and Testimony Enterprises Limited in a separate civil case.
The accused are scheduled to appear in court on October 19, 2026, for mitigation and sentencing on the reinstated money laundering charges.
