Two men have been sentenced to death after being found guilty of robbery with violence at the Moyale Law Courts in Marsabit County.
Nashon Ochieng Agutu and Jackson Okech Odhiambo were convicted on four counts of robbery with violence following a case linked to an incident in the Dabel area of Moyale on April 23, 2025.
The court heard that the two men, together with other accomplices, attacked their victims while armed with guns and other dangerous weapons. During the robbery, the victims lost cash, mobile phones and other personal belongings. They were also assaulted and suffered injuries during the incident.
The prosecution presented evidence linking Agutu and Odhiambo to the robbery. After considering the evidence presented before the court, Senior Principal Magistrate Willy Cheruiyot found the two men guilty of the offences.
The court subsequently sentenced both men to death for the robbery with violence. The case followed investigations into the attack in the Dabel area, where the victims were reportedly confronted by the suspects and their accomplices.
Robbery with violence is a serious offence under Kenyan law, particularly where attackers are armed or cause injuries to their victims. The prosecution in this case relied on evidence presented during the trial to establish the men's involvement in the attack.
Following the sentencing, Agutu and Odhiambo have been given 14 days within which to appeal against both their conviction and the sentence. The sentence brings the trial at the Moyale Law Courts to a close for now, although the two men can still
challenge the court's decision through the appeal process.
The case highlights the serious consequences faced by people convicted of violent robberies in Kenya, especially where weapons are used and victims are injured during an attack.
